Medicaid Eligibility: Frequently Asked Questions

If you are disabled or over the age of 65, you may qualify for Medicaid’s A and D waiver.  This waiver provides funds to support families with caregiving in the home, or with assistance with rent in an assisted living or skilled nursing facility.  We assist clients in applying for these waivers every day.

Medicaid allows a separation of assets to support what they call a “community spouse”. One partner may qualify for Medicaid while the other partner maintains their way of life with little to no financial impact. Legacy Navigation has worked with countless couples to assist them in getting Medicaid services while protecting the community spouse and allowing clients to stay married.

Medicaid has many asset exemptions that help protect you from losing your assets such as your house or car. Legacy Navigation is well versed in knowing the pitfalls to avoid and the hoops to jump through in order to maintain and protect your assets.

In some states, Medicaid will allow you to funnel some money into what is called a “Miller Trust” which allows you to qualify for assistance while being able to continue to pay for your monthly needs. Legacy Navigation works closely with financial institutions and will walk you through establishment of these trusts. If you live in a state that does not allow Miller Trusts, but your income is below the cost of your care, you are income-eligible for Medicaid. Contact us to learn more.
